Welcome to Echo (“Echo”, “we”, “us”, or “our”). These Terms & Conditions (“Terms”) govern your access to and use of the Echo mobile application and related services (collectively, the “Service”). By accessing or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
Echo, our logos, and other marks are trademarks of Echo. Except for your User Content, all materials in the Service are owned by Echo or its licensors and are protected by intellectual property laws. Except as expressly allowed by these Terms, you may not copy, modify, or create derivative works from the Service.
The Service may link to third-party websites, apps, or services. We are not responsible for those third parties’ content, policies, or practices. Your use of third-party services is at your own risk and may be subject to their terms.
We may offer paid features in the future. Purchases made through the Apple App Store are billed by Apple and may be subject to Apple’s terms and refund policies. Unless required by law, all purchases are final.
Your use of the Service is subject to our Privacy Policy, which explains how we collect, use, and share information about you.
If you believe that content on Echo infringes your copyright, you may send a notice to the contact below. Your notice should include the information required by 17 U.S.C. §512(c)(3). We may remove content and terminate repeat infringers where appropriate.
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that the Service will be uninterrupted, secure, or error-free.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, ECHO WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, OR REVENUE, ARISING OUT OF OR RELATED TO YOUR USE OF (OR INABILITY TO USE) THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID (IF ANY) FOR THE SERVICE IN THE 12 MONTHS BEFORE THE CLAIM AROSE OR (B) USD $100.
You agree to defend, indemnify, and hold harmless Echo and its affiliates, officers, employees, and agents from and against any claims, damages, liabilities, costs, and expenses arising out of or related to your User Content, your use of the Service, or your violation of these Terms.
You may stop using the Service at any time. We may suspend or terminate your access if we believe you have violated these Terms or if needed to protect the Service or its users. Upon termination, the rights and licenses granted to you will end; certain sections (including 2, 9–13) will survive.
These Terms are governed by the laws of the United States and the laws of the state where Echo is organized, without regard to conflicts of law principles. You agree to the exclusive jurisdiction and venue of courts located in that state for any dispute that is not subject to alternative dispute resolution.
We may modify the Service and these Terms from time to time. If changes are material, we will provide notice in the app or by other appropriate means. Your continued use of the Service after the effective date of updated Terms constitutes your acceptance.
